Some of the recent tidbits have slipped outside of the bounds of what this forum was intended, but it is OK. The issue that needs a little explaining is the recent bankruptcy that has everyone talking, good and bad. Understand people what the reason is for a bankruptcy. It could be caused by any number of factors, some including poor management, and some with good management, but unforeseen events such as our downturn in the economy, natural disaster, employee theft, medical expenses, or many other reasons beyond the owners control have lead to the reason people file for bankruptcy. Before there was bankruptcy, there was debtors prison. Obviously the debtors prison was counter productive. A person would stay in prison until the debt was paid. If they could not work because they were in prison, they could not earn their way out. Honestly, do any of you want to go back to the days of the debtors prison? The true intent of bankruptcy according to the great jurist Oliver Wendell Holmes, was to "rehabilitate the debtor". I am not so naive as to believe that no one has ever taken advantage of our bankruptcy laws, they have. But if you do not know exactly why a business or an individual has filed for bankruptcy, do not judge. Watch how they handle their affairs during and after they have filed. This is the only true test of character. I personally do not have a dog in this fight. I may have lost a few dollars, but that is part of the price of doing business. I had almost four million dollars on my books when Federated Department Stores filed Bankruptcy in 1989. Thru hard work and a very smart attorney, as well as the hard work by the people at Federated, we recovered more than 95 cent on the dollar over a period of just over four years. So folks, remember, this is America, everyone deserves a second chance. I will continue to post and shed light on the people in our industry who have caused grave harm. My entire career has been spent in?the window covering?industry. An industry that I love and am seeing fall apart. It breaks my heart to see good people and manufactures go out of business because they can't compete due to price or because they have been taken advantage of. Jason, you are a master at twisting words and the facts so that they suit you. Never mind the truth.?I guess your legal training has paid off. I always wondered why they called lawyers snakes but after doing business with you I understand. You are slipperier that a snake dipped in oil. As for your bankruptcy comments, you stated to me over the phone that you were, "not going to pay your past due bills and that there was nothing to get as you were shutting down Home View and were filing bankruptcy." In fact you told me I had 1 day to pick up your old inventory that you purchased from me and I was to use that towards your past due monies owed. If you remember correctly, I didn't pick up the wood components and you kindly sent me a picture of my wood in your trash bins. Based on your words to me over the phone, I took that to mean you filed bankruptcy. A few days later I come to learn that you opened up under another name. National Blind/Genesis. As for Summitt attempting to sue Home View. It was for unpaid bills. Plain and simple. You bought goods and never paid for them. Some of the other vendors that were left unpaid were ACS, Lumber Products, Lassen and Mariak just to name a few. I spoke at great length with Home View's landlord and was was told they left in the middle of the night and he had no idea where Home View was but he would love to find them as he was left with unpaid rent. I spoke with numerous suppliers to Home View and no one knew where Jason was. We attempted numerous times at serving him at various locations in CA and in Texas and he was masterful at the duck and dodge and manipulating the legal system. Bottom line, there is a point of no return when there are lawyers involved. Are we really going to spend $20,000 to get $10,000?? It made no sense so we dropped it. I guess Jason interprets unpaid bills over $10,000.00 a frivolous lawsuit. Now I am sure another fun-filled post will come back from Jason making all sorts of claims and threats. If for some reason you are to question the validity of Home View and how they screwed the suppliers that supported them for so long, just contact one of the names above. And Jason, in regards to your offer of $10,000.00 cold hard cash, just pay your bill and we will call it even. Lisa --- END OF DIGEST ---
